Terms of Service

By accessing and using the services of ABINFRA ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

ABINFRA provides construction, infrastructure development, farm & partyplot, and related services. All services are provided subject to the terms and conditions set forth in individual project agreements, which shall be executed prior to commencement of work.

Each construction project requires a separate written agreement that will detail: • Scope of work and project specifications • Timeline and milestones • Payment terms and schedule • Materials and quality standards • Warranty terms • Change order procedures The project agreement supersedes these general terms for project-specific matters.

Payment terms will be specified in each project agreement. Generally: • Initial deposit may be required upon contract signing • Progress payments are due upon completion of specified milestones • Final payment is due upon project completion and acceptance • Late payments may incur interest charges as specified in the project agreement All prices are subject to change based on material costs, labor rates, and other factors beyond our control.

We commit to completing projects within agreed timelines. However, timelines may be affected by: • Weather conditions • Material availability • Regulatory approvals and permits • Client-requested changes • Unforeseen site conditions We will communicate any delays promptly and work to minimize their impact.

ABINFRA is committed to delivering high-quality construction using premium materials. We maintain strict quality control standards throughout all projects. Material specifications will be detailed in project agreements, and any substitutions will be discussed and approved by the client.

We provide warranties on workmanship and materials as specified in individual project agreements. Warranties typically cover: • Structural defects for a specified period • Workmanship defects • Material defects Warranty claims must be reported promptly and in writing. Warranties do not cover damage from normal wear and tear, misuse, or modifications made by others.

Any changes to the original project scope, specifications, or timeline must be documented in a written change order signed by both parties. Change orders may affect project cost and timeline. Work on changes will not commence until the change order is approved.

Clients are responsible for: • Obtaining necessary permits and approvals (unless otherwise agreed) • Providing accurate site information and access • Making timely decisions and approvals • Ensuring site security and safety • Timely payment as per agreement Delays caused by client inaction may result in timeline adjustments and additional costs.

We maintain strict safety standards and comply with all applicable building codes, regulations, and safety requirements. We carry appropriate insurance coverage for our operations. Clients are responsible for maintaining their own insurance as appropriate.

To the maximum extent permitted by law, ABINFRA's liability is limited to the contract value of the specific project. We are not liable for indirect, consequential, or incidental damages. Our liability for any claim shall not exceed the amount paid by the client for the specific work giving rise to the claim.

All designs, plans, drawings, and specifications created by ABINFRA remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use these materials for the specific project only.

Either party may terminate a project agreement in accordance with its terms. Upon termination: • Payment is due for all work completed • Materials ordered and delivered become client property upon payment • We retain the right to remove our equipment and materials Termination does not affect rights accrued prior to termination.

In the event of disputes, parties agree to first attempt resolution through good faith negotiation. If unresolved, disputes may be subject to mediation or arbitration as specified in the project agreement, or as required by applicable law.

Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including natural disasters, war, terrorism, labor disputes, material shortages, or government actions.

ABINFRA reserves the right to modify these terms at any time. Changes will be effective upon posting. Continued use of our services after changes constitutes acceptance of modified terms.

These terms are governed by the laws of India. Any legal proceedings shall be subject to the jurisdiction of courts in Mumbai, Maharashtra, India.
